The following Terms and Conditions also contain legal information regarding your rights under the regulations governing distance selling and e-commerce.
1 Scope of Application, Contracting Parties
1.1 These General Terms and Conditions (“GTC”) apply to all contracts concluded between you as the customer (“you”) and nacani GmbH (“nacani”), the operator of the online store at www.nacani.de (“nacani Webshop”). As part of the ordering process, you accept the GTC in the version valid at the time the order is placed. Any deviating or supplementary general terms and conditions of the customer shall apply only to the extent that nacani has agreed to them in writing in individual cases.
1.2 These Terms and Conditions apply to consumers. According to the legal definition (§13 BGB), a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

2. Conclusion of the Contract
2.1 The presentation of products in the online store does not constitute a binding offer to sell. The items you select are initially placed in a virtual shopping cart. Items in the shopping cart are not reserved for you and may be purchased by other customers in the meantime. After entering your contact, payment, and shipping information, you submit a binding offer to purchase by clicking the order button. Before doing so, you have the opportunity to review your details and, if necessary, make changes or correct any input errors. Your binding order can only be shipped if you have expressly accepted these Terms and Conditions. The offer to conclude a purchase contract is made by you as the customer by clicking the [Submit Order] button.
2.2 Confirmation of receipt of your order is provided via an automated email immediately after you submit your order; this does not constitute acceptance of the contract by nacani, but is provided for your information only.
2.3 The contract is only concluded upon receipt of an explicit order confirmation via email from nacani or upon shipment of the ordered goods.
3 Delivery, Product Availability, Right of Withdrawal
3.1 The delivery period begins as soon as full payment of the purchase price has been received. Your order will be prepared for shipment and sent to you within two to three business days of receipt of the purchase price.
3.2 Once your order has been shipped, you will receive an email with a tracking number that allows you to track your order online.
3.3 If an ordered product is unavailable, nacani may reject your purchase offer. In this case, nacani will inform you immediately and promptly refund any payment already made.
4 Prices, Shipping Costs, Customs Duties
4.1 The final prices listed in the online store include the applicable value-added tax. The prices listed apply to deliveries to countries within the EU and include the sales tax applicable in Germany.
Prices for deliveries to countries within the European Union (“EU”) are listed in euros (EUR). Any refunds will also be based on the original payment you made, without taking into account fluctuations in exchange rates.
4.2 The purchase price is due immediately upon conclusion of the contract.
4.3 Shipping Costs
Germany
Standard (3–5 business days): €4.60; orders over €100 qualify for free shipping.
Austria
Standard (3–5 business days): €10.70; orders over €200 qualify for free shipping.
EU countries
Standard (3–5 business days): €11.45–€14.50, varying by country. Free shipping on orders of €200 or more.

4.4 When shipping to non-EU countries, additional taxes and fees (e.g., customs duties) may apply to your order. We are unable to collect or invoice these amounts; instead, you must pay them directly to the relevant customs or tax authorities. Please contact these authorities for further details.
5 Payment, Retention of Title, Insurance
5.1 We only accept the payment methods displayed to you when placing your order: credit card payments via VISA and MASTERCARD, payment via PAYPAL and SOFORTÜBERWEISUNG, direct bank transfer, or SEPA direct debit.
When paying via SOFORT-Überweisung, the payment is processed by SOFORT GmbH, Fußbergstraße 1, 82131 Gauting.
If you pay by credit card or another payment method where your account is not denominated in the currency specified at the time of purchase, your account will be charged based on the exchange rate in effect when your card issuer or payment service provider processes the transaction, as determined by them.
Your PayPal payment will be processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. The respective terms and conditions of the contracting parties apply. When you pay with PayPal, you will be redirected to the PayPal page at checkout, where you can log in and complete the payment process. Once payment has been made, you will be redirected back to nacani.
All transactions on this website are processed through Stripe. This is a secure online payment gateway where your payment information is encrypted in a secure hosting environment.
nacani GmbH also offers you the option to save your credit card information so that you can shop with us more quickly and easily. Your full credit card number is not displayed—only the last four digits are visible. This allows you to quickly and easily identify which of your credit cards you are using. You can delete your credit card information at any time by deactivating the “Save my payment methods” feature on the payment page.
Please note that you will need to re-enter your credit card information if you wish to change your existing addresses or add new ones. This is to protect your personal information from third parties.
5.2 The delivered goods remain the property of nacani until full payment has been made
5.3 Your order is insured by nacani during transit until the time of delivery. Upon delivery and signature, liability for the purchased items transfers to you. If you are not the recipient yourself (for example, in the case of a gift), you accept that nacani has fulfilled its contractual obligations and that liability has transferred to the recipient.
6 Statutory Right of Withdrawal / Returns
6.1 Consumers have a statutory right of withdrawal when entering into a distance sale, and nacaninach provides information on this right below in accordance with the statutory template.
Cancellation Policy
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party designated by you, other than the carrier, took possession of the goods. If you have ordered multiple items as part of a single order and these items are delivered separately, the cancellation period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last item.
To exercise your right of withdrawal, you must inform us (nacani) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail or an email).
To meet the deadline for cancellation, it is sufficient for you to send notification of your intention to cancel before the cancellation period expires.
Exclusion of the Right of Withdrawal
Packages that have already been opened cannot be returned unless there is a clear product defect.
Consequences of Cancellation
If you cancel this contract, we will refund all payments we have received from you, including delivery costs (except for any costs resulting from your choice of a delivery method other than the cheapest standard delivery option we offer), without delay and no later than fifteen days from the day we receive the returned goods. This refund will be made using the same payment method you used for the original transaction, unless expressly agreed otherwise; in no event will you be charged any fees for this refund. The refund may be withheld until nacani has received the goods back or until you have provided proof that you have returned the goods, whichever occurs first.
You must return or hand over the goods without delay and, in any event, no later than fourteen days from the date on which you notify nacani of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires.
You are responsible for the direct costs of returning the goods. The return shipment must be insured and trackable when sent back to nacani. You are only liable for any loss in value of the goods if such loss is attributable to handling of the goods that goes beyond what is necessary to ascertain their nature, characteristics, and functioning.
6.2 In accordance with the law, nacani provides the following information regarding the model cancellation form:

Please return only items that are new and unopened. The merchandise must also be returned complete, i.e., in its original sales packaging along with any instructions and undamaged seals or other components. Returns that do not meet these requirements will not be accepted and will be returned to you.
7. Statutory Warranty
Your rights regarding material defects and defects of title are governed by applicable law. nacani is liable for damages exclusively in accordance with Section 8.
8 Liability for Damages
8.1 Unless otherwise specified below, nacani shall be liable for damages in accordance with applicable law.
8.2 In the event of a breach of duty—regardless of the legal basis—nacani shall be liable under the principle of fault-based liability for intentional acts and gross negligence. Subject to a less stringent standard of liability under statutory provisions (e.g., regarding the standard of care in its own affairs), nacani shall be liable for simple negligence only:
- for damages resulting from injury to life, limb, or health, and
- for damages resulting from a material breach of a fundamental contractual obligation (an obligation whose fulfillment is essential for the proper performance of the contract and on whose observance the other party regularly relies and is entitled to rely); in such cases, however, liability is limited to compensation for foreseeable, typically occurring damages.
The foregoing limitations of liability also apply in relation to third parties and in the event of breaches of duty committed by or in favor of persons for whose fault nacani is liable under applicable law.

12 Final Provisions
12.1 These General Terms and Conditions and the contractual relationship with you are governed by German law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
12.2 When the customer places an order through our online store, only the German version of these Terms and Conditions applies.
12.3 If any provision of these General Terms and Conditions is invalid, the remainder of the contract shall remain in full force and effect. The invalid provision shall be replaced by the relevant statutory provisions.
